    Personal Data may be freely provided by the User, or, in case of Usage Data, collected automatically when using this Website.
    Unless specified otherwise, all data requested by this Website is required for this Website to provide its Service.     For non-UAE employers, the Owner conducts equivalent verification appropriate to the employer's jurisdiction and ensures through binding contractual terms that such employers comply with UAE PDPL requirements when processing UAE residents' data, including adherence to the principles set forth in UAE PDPL (lawfulness, fairness and transparency; purpose limitation; data minimization; accuracy; storage limitation; integrity and confidentiality; and accountability).
  • You have the right to submit requests directly to any employer that holds or processes your CV, such as requesting access, correction, deletion, or portability, in accordance with their privacy policies. The Owner is not responsible for managing or fulfilling data subject requests for copies of your CV data that exist in the employer's system after transfer. You should review the privacy policy or data protection statement of the employer receiving your CV for more information on your rights.
    CV and Profile Data Retention
    Once your CV or profile data is exported to an employer's system, the Owner no longer controls retention, deletion or further processing of that copy - such responsibilities rest solely with the receiving employer (as Data Controller) who will determine the retention period according to their policy or legal obligations.
    You may request deletion of your CV or profile from the Owner's systems, but this request does not extend to copies of your data held by employers or ATS systems outside the Owner's control.
    CV data retained by the Owner will be retained as specified in this privacy policy. Employers who have accessed User data prior to deletion remain subject to their own data retention obligations.
  • This section applies to all Users in the UAE under the UAE PDPL; and all Users in the European Union under the General Data Protection Regulation (“GDPR”).

    Users outside the UAE and EU who use this Website acknowledge and consent to the fact that their Data will be processed in accordance with UAE law as the primary governing framework. Where users are located in jurisdictions with data protection laws that provide greater protections than UAE law, the Owner will endeavour to comply with such additional protections to the extent reasonably practicable, but UAE law shall govern in case of conflict.

    Legal basis of processing
    The Owner may process Personal Data relating to Users if one of the following applies. For UAE users, processing is conducted in accordance with UAE PDPL; for EU users, processing is conducted in accordance with GDPR :

    Cross-Border Data Transfers
    When UAE Users’ Personal Data is accessed by employers located outside the UAE, such transfers are subject to UAE PDPL requirements. The Owner ensures that adequate safeguards are in place before any transfer occurs, relying on one or more of the following mechanisms:
    (a) standard contractual clauses approved by the UAE Data Office requiring recipient employers to provide a level of protection equivalent to that required under UAE PDPL;
    (b) verification that the recipient country has been deemed to provide adequate protection by the UAE Data Office through an adequacy decision; or
    (c) obtaining explicit consent from Users after informing them of the risks associated with the transfer to a country that may not provide adequate protection.

    Cross-border data transfers from UAE (for example to store Personal Data in Frankfurt, Germany are conducted in accordance with UAE PDPL. Under UAE PDPL, international transfers require either an adequacy decision, appropriate safeguards (including Standard Contractual Clauses approved by the applicable data authorities), or explicit consent, and Users have the right to be informed of the specific transfer mechanism used. Users may request copies of these safeguards by contacting the Owner. Users in the UAE and EU are informed that data transferred to the United States may not provide the same level of data protection as the UAE or EU.

    Users may object to such transfers through their account settings or by contacting the Owner directly using the contact information provided in this privacy policy. The Owner will acknowledge, review, and respond to such objections within a reasonable timeframe in accordance with applicable data protection laws. If the objection is upheld, the User's data will not be transferred to the specified recipient. If the objection cannot be upheld due to overriding legitimate grounds or legal obligations, the Owner will inform the User of the reasons and their right to lodge a complaint with the UAE Data Office.

    Data Retention
    Unless specified otherwise in this document, Personal Data shall be processed and stored for as long as required by the purpose for which they have been collected and may be retained for longer due to applicable legal obligation or based on the Users’ consent. The Owner maintains a data retention schedule that complies with both UAE PDPL and GDPR requirements. Users may request deletion of their Personal Data prior to the expiration of the retention period, subject to the exceptions set forth in this document.
    Therefore:
    • Personal Data collected for purposes related to the performance of a contract between the Owner and the User shall be retained until such contract has been fully performed.
    • Personal Data collected for the purposes of the Owner’s legitimate interests shall be retained as long as needed to fulfill such purposes, provided that such interests do not override the fundamental rights and freedoms of the data subject.     The Owner may be allowed to retain Personal Data for a longer period whenever the User has given consent to such processing, as long as such consent is not withdrawn. Furthermore, the Owner may be obliged to retain Personal Data for a longer period whenever required to fulfill a legal obligation or upon order of an authority.     The rights of Users based on the UAE PDPL and GDPR
    Users may exercise certain rights regarding their Personal Data processed by the Owner. Users in the UAE have rights under UAE PDPL, while Users in the EU have rights under the GDPR. Many of these rights are substantially similar, and the Owner is committed to honouring all applicable user rights regardless of jurisdiction. Where rights differ between jurisdictions, the Owner will apply the standard that provides greater protection to the User, except where doing so would violate applicable law or create conflicting legal obligations. To exercise any of these rights, Users may submit a request using the Data Subject Request Form available at https://www.bayt.com/en/data-subject-request/.
    In particular, Users have the right to do the following, to the extent permitted by law:
    • Withdraw their consent at any time. Users have the right to withdraw consent where they have previously given their consent to the processing of their Personal Data. Withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal.
    • Object to processing of their Personal Data. Users have the right to object to the processing of their Personal Data if the processing is carried out on a legal basis other than consent, including processing based on legitimate interests or for the performance of a task carried out in the public interest.
    • Access their Personal Data.     • Restrict the processing of their Personal Data. Users have the right to restrict the processing of their Personal Data in certain circumstances, including when the accuracy of the Personal Data is contested, the processing is unlawful, or the User has objected to processing.     Where Personal Data is processed for a public interest, in the exercise of an official authority vested in the Owner or for the purposes of the legitimate interests pursued by the Owner, Users may object to such processing by providing a ground related to their particular situation to justify the objection. The Owner will cease processing unless it can demonstrate compelling legitimate grounds for the processing which override the interests, rights and freedoms of the User, or for the establishment, exercise or defense of legal claims.
    Users must know that, however, should their Personal Data be processed for direct marketing purposes, they can object to that processing at any time, free of charge and without providing any justification. Where the User objects to processing for direct marketing purposes, the Personal Data will no longer be processed for such purposes.     How to exercise these rights
    Any requests to exercise User rights can be directed to the Owner through the contact details provided in this document or by completing the Data Subject Request Form available at https://www.bayt.com/en/data-subject-request/. Such requests are free of charge and will be answered by the Owner as early as possible.
    Response Timeframes
    * Under the GDPR: within one month of receipt of the request, which may be extended by two further months where necessary, taking into account the complexity and number of requests. The Owner will inform the User of any such extension within one month of receipt of the request, together with the reasons for the delay.
    * Under the UAE PDPL: within 15 business days from the date of receipt of the request, or such other reasonable timeframe as specified in the Executive Regulations. Where the Owner requires additional time, it will notify the User and provide reasons for the delay.
    The response will provide Users with the information required by law. Any rectification or erasure of Personal Data or restriction of processing will be communicated by the Owner to each recipient, if any, to whom the Personal Data has been disclosed unless this proves impossible or involves disproportionate effort. At the Users’ request, the Owner will inform them about those recipients.
    Employer Verification: The Owner conducts verification checks on all employers, including mandatory validation of UAE trade licenses and commercial registration for UAE-based employers, before granting access to User data.
    The Owner maintains records of all employer verification activities in accordance with UAE PDPL for a minimum of five years.
