Mediation is   a way of resolving disputes between two or more parties with concrete effects. Typically, a third party, the mediator, assists the parties to negotiate a settlement to reach agreement.

The difference between Mediation and Negotiation

Negotiation: The parties agree to work with each other to resolve a dispute. Mediation: The parties agree to work with a facilitator or mediator to resolve a dispute. Negotiation: The parties always meet with each other. Mediation: A mediator may meet with both parties jointly or meet individually with one party which is called a caucus. Negotiation: The parties can bind themselves in an agreement. Mediation: The mediator has no decision-making authority and cannot bind the parties. A mediator does not make a ruling like a judge or arbitrator. Negotiation: The parties have their own interests in the negotiation. Mediation: The mediator is neutral and impartial and does not represent either party's interests. Negotiation: The parties use persuasion to get the other side to agree with them Mediation: The mediator may play devil's advocate or give a reality check to the parties, but it is not the mediator's role to persuade the parties. Negotiation: Some negotiations fail because the parties cannot work with each other. Mediation: A mediator may be used because the parties prefer a third party. Negotiation: Some negotiations fail because the parties have too many conflicts. Mediation: A mediator may be able to defuse conflicts or disagreements. Negotiation: Some negotiations are not voluntary such as union negotiations. Mediation: Mediation is voluntary and either party may choose to stop at any time. Negotiation: When the parties can't agree, they reach a deadlock or impasse Mediation: When negotiations reach an impasse, the parties may try mediation .

When the negotiating parties do not reach to an agreement, they may practice "Mediation". "Mediation" is a channel to resolve unsettled issues between the negotiating parties with the help of a third party known as "mediator".

A mediator come in between with the will and mutual consent of  the negotiating parties. A mediator is neither a decision maker nor the authority to impose anything on either party. Mediator is a neutral and impartial body and cannot have any interest with either party.

A mediator helps parties to negotiate, provides the parties with  the frame and the adequate  tools for them to reach a decision.  A decision taken by the parties not imposed by a third party has much more chances of become effective or being implemented voluntary by the parties.

What is happening in mediation (the process itself and information revealed by parties)  is confidential and it cannot be used in court for future referrences.

Negotiation is easier  because usually is based only on one party perspective, the art of mediation helps parties to also understand the other party perspective and to collaborate. Mediation gives to the parties the  chance to preserve or repair the human connection - relationship.

From practice I can tell is easier to be a negotiatior than a mediator :).

Negotiatior perspective; I know what is best for me!

Mediator persepctive: I know that you know what is best for you,  and I can help you to understand what is best for all of you and to decide together  accordingly.

Mediator plays the same role as of equilateral in triangle .He should keep himself neutral while mediation between two parties . On the other hand meanwhile the coversation between two parties to reach any solution or conclude any matter is known as negotiation.
